Refund Policy & Advance Booking Non-Refundability Standard

Comprehensive legal statement governing financial transactions, advance token allocations, vehicle locking commitments, and strict non-refundable advance booking terms for Shree Ji Travels.

📅 Effective Policy Year: 2025 – 2026 • 🚫 Advance Deposit: Strictly 100% Non-Refundable • ⚖ Indian Contract Act 1872 & Commercial Transport Law

⚠️ STRICT ADVANCE BOOKING TOKEN NON-REFUNDABILITY NOTICE

PLEASE READ CAREFULLY PRIOR TO REMITTING ANY MONETARY ADVANCE: At Shree Ji Travels, once an advance reservation deposit (token amount, booking advance, or fleet block fee) is remitted to lock a specific vehicle (including 9 to 26 seater Tempo Travellers, Maharaja coaches, or Urbania luxury vans), THAT ADVANCE AMOUNT BECOMES IMMEDIATELY AND IRREVOCABLY 100% NON-REFUNDABLE under any circumstances. Fleet reservations represent perishable commercial inventory that is instantly withdrawn from the open market, scheduled with dedicated commercial chauffeurs, and pre-allocated with fuel, permits, and maintenance dry runs. Under no conditions shall cash refunds be disbursed for customer-initiated cancellations.

Section 01

1. Commercial Transport Economics & Fleet Commitment Philosophy

Shree Ji Travels (hereinafter "SJT", "the Company", "we", or "us") operates high-capacity commercial tourist vehicles across North India. Unlike standard shared public transport or digital ride-hailing aggregators operating dynamic on-demand algorithms, private charter passenger transit functions upon custom fleet dedication models.

When you book a dedicated tempo traveller (whether for local Delhi NCR corporate dispatch, an outstation wedding entourage to Jaipur, a pilgrimage tour to Char Dham or Mathura-Vrindavan, or a mountain expedition to Shimla-Manali), our operations command center executes irreversible resource commitments:

  • Inventory Lockdown: That specific vehicle registration number is immediately removed from public booking channels, preventing hundreds of other prospective hirers from reserving that asset for the chosen dates.
  • Chauffeur Assignment & Roster Freezing: A licensed, experienced commercial chauffeur is rostered exclusively for your journey, rejecting alternative outstation duty contracts and earning opportunities.
  • Pre-Trip Mechanical & Sanitization Overhaul: The assigned vehicle undergoes comprehensive garage fluid checks, air-conditioning diagnostic tests, suspension tuning, and complete interior deep sanitization 24 to 48 hours prior to journey reporting.
  • Statutory Interstate Tax Pre-Allocations: Necessary commercial transport permits and toll gateway tag pre-authorizations are initiated through state transport portals.

Consequently, any subsequent reservation cancellation inflicts immediate, unrecoverable operational and business losses upon Shree Ji Travels. Our strict non-refundable advance booking policy is formulated to safeguard fleet viability, driver livelihood, and operational sustainability.

Section 02

2. Absolute Non-Refundability of Advance Booking / Token Amounts

This section delineates the non-negotiable financial terms governing all client deposits remitted to Shree Ji Travels:

A. Token / Advance Booking Deposit

The advance booking deposit (typically 20% to 50% of the total estimated trip fare, depending on vehicle capacity, seasonal peak demand, and itinerary duration) serves as legal consideration under Section 2(d) of the Indian Contract Act, 1872 to execute fleet reservation. Once transacted via UPI, NEFT/RTGS, payment gateway, or cash, no portion of this advance amount is eligible for monetary refund, regardless of the timing of cancellation, whether made weeks in advance or hours prior to departure.

B. Zero Exceptions for Personal Contingencies

Shree Ji Travels expresses profound empathy for individual family emergencies, health challenges, wedding schedule postponements, corporate meeting cancellations, personal flight reschedulings, or unexpected domestic changes. However, as an asset-intensive commercial carrier, we cannot absorb financial liability for client-side contingencies. The advance booking fee remains strictly non-refundable irrespective of personal, corporate, or domestic justifications.

Section 03

3. Comprehensive Cancellation Slabs & Financial Liabilities

To ensure complete contractual transparency, the following table defines client financial liabilities across various cancellation timeline brackets:

Cancellation Notice Window Status of Advance Booking Amount Balance Trip Fare Liability
More than 15 Days Prior to Departure 100% Forfeited & Non-Refundable No liability for remaining balance fare. Hirer is released from outstanding balance dues.
7 to 14 Days Prior to Departure 100% Forfeited & Non-Refundable Client may request credit voucher consideration for date rescheduling (subject to Section 4 terms).
48 to 72 Hours Prior to Departure 100% Forfeited & Non-Refundable Hirer liable for 50% of total estimated journey billing if special state permits or fuel prepayments were completed.
Less than 48 Hours Prior to Departure 100% Forfeited & Non-Refundable Hirer liable for 100% of minimum daily package rental (garage-to-garage baseline) as liquidated damages.
Same-Day / Client No-Show at Boarding Point 100% Forfeited & Non-Refundable Vehicle dispatched from depot: Hirer liable for full 100% trip contract value including driver day allowance.
Section 04

4. Conditional Credit Voucher & Journey Rescheduling Framework

While cash refunds are unequivocally precluded, Shree Ji Travels seeks to maintain enduring relationships with our esteemed patrons. Under strictly defined parameters, our executive management may, at its sole discretion, issue an SJT Travel Credit Voucher in lieu of complete forfeiture:

Eligibility Requirements for Credit Vouchers

  • Minimum Advance Notice: Written cancellation or rescheduling request must be received on our official email (info@shrijeetravels.com) at least seven (7) full calendar days prior to the scheduled departure timestamp.
  • Non-Peak Travel Season: Credit notes cannot be issued for cancellations during peak national holiday windows, including Diwali, New Year week (Dec 25 to Jan 2), Holi, long national holiday weekends, or high-demand Char Dham peak months (May-June).
  • Administrative Rescheduling Fee: A nominal 15% administrative and logistics rescheduling levy is deducted from the advance amount to cover vehicle re-indexing costs.

Credit Voucher Utilization Terms

  • Validity Window: The issued SJT Travel Credit Voucher remains valid for redemption for a period of exactly one hundred and eighty (180) calendar days from the date of formal issuance.
  • Non-Transferability: The credit voucher is registered exclusively to the primary booking hirer and cannot be transferred, sold, or assigned to third-party entities.
  • Prevailing Tariff Application: When redeeming the voucher for a future date, the booking will be calculated based on the prevailing seasonal tariff rates at the time of new departure, not the original quotation rates.
Section 05

5. Exceptional Circumstances Warranting Company-Initiated Refunds

Shree Ji Travels stands firmly behind our operational integrity. In the extremely improbable scenario where service disruption arises directly from internal operational shortcomings on our part, fair financial restitution is guaranteed:

A. Failure to Dispatch Fleet Asset

If Shree Ji Travels fails to dispatch the booked vehicle category or an equivalent higher-category upgrade due to internal logistical collapse or catastrophic fleet shortfall, and no alternative transport is provided within 120 minutes of scheduled reporting, the client is entitled to a 100% full refund of the remitted advance booking deposit.

B. Highway Mechanical Breakdown Protocol

In the rare event of major mechanical engine failure during highway transit, our standard operating protocol requires immediate dispatch of a relief replacement vehicle from our nearest regional partner hub. If Shree Ji Travels is unable to deploy a replacement vehicle within four (4) hours, we will calculate the pro-rata fare for the uncompleted journey segment and disburse an equitable partial refund within 5 to 7 business days.

Section 06

6. Force Majeure & Act of God Disclaimer

Neither party shall be held financially liable for default or delays resulting from events beyond reasonable human control, collectively termed Force Majeure. These include, but are not limited to:

  • Severe natural catastrophes, cloudbursts, severe flash floods, earthquakes, active landslides causing state highway blockages in Uttarakhand, Himachal Pradesh, Jammu & Kashmir, or Rajasthan.
  • Sudden governmental proclamations, border sealings, curfews, Section 144 impositions, municipal road closures, or interstate transport union strikes.
  • National security emergencies, armed civil conflict, severe civic agitations, or epidemic quarantine lockdowns enforced by public health directives.

Force Majeure Settlement Terms: When a journey becomes impossible due to Force Majeure prior to vehicle departure from our garage, the advance booking amount is converted into a 100% Non-Expiring SJT Force Majeure Credit Note, redeemable across any subsequent travel itinerary. No liquid cash refunds are disbursed under Force Majeure events, as the carrier has incurred unrecoverable administrative, insurance, and fleet readiness liabilities.

Section 07

7. Anti-Chargeback Agreement & Financial Indemnity

By remitting an advance payment to Shree Ji Travels, the hirer explicitly enters into a legally binding bilateral commercial contract under the laws of India. The hirer formally covenants and agrees:

  • Not to initiate deceptive, frivolous, or fraudulent payment chargebacks, reversals, or dispute claims through credit card issuers, acquiring banks, or UPI payment apps for non-refundable advance deposits legitimately transacted under this policy.
  • That any unilateral chargeback filed in contravention of this explicit agreement shall be treated as a contractual breach. Shree Ji Travels reserves the unrestricted right to submit booking vouchers, WhatsApp communications, and this signed policy to banking dispute tribunals.
  • The hirer agrees to fully indemnify Shree Ji Travels for all legal expenses, banking penalty levies, and administrative costs incurred in successfully defending against wrongful chargeback claims.
Section 08

8. Multi-Vehicle Charters, Corporate Retainers & Wedding Entourages

Large-scale group movements involving multiple vehicles (such as corporate offsites, industrial delegations, destination wedding convoys, or religious sanghas chartering three or more tempo travellers simultaneously) require elevated logistics coordination and distinct financial terms:

  • Staged Advance Payments: For multi-vehicle charters, an initial 25% non-refundable token deposit is required to block fleet allocations, followed by an additional 25% interim installment thirty (30) days prior to departure, with the 50% balance cleared on vehicle arrival at the reporting terminal.
  • Individual Vehicle Partial Cancellations: If a hirer contracts five (5) vehicles and subsequently wishes to scale down to three (3) vehicles, the advance amounts allocated to the two cancelled assets cannot be transferred, credited, or adjusted against the remaining three vehicles. The advance on each individual vehicle stands strictly non-refundable and forfeited.
  • Pre-Trip Driver Recce Charges: If custom route reconnaissance or dedicated driver route training was conducted for specialized wedding itineraries or VIP protocols, all recce expenditures remain 100% billable and non-refundable.
Section 09

9. Pre-Trip Vehicle Inspection, Cleanliness & Passenger Handover Sign-Off

To prevent post-trip disputes regarding vehicle condition or amenity delivery, Shree Ji Travels enforces a transparent departure verification protocol:

Pre-Departure Joint Inspection

Upon vehicle arrival at the designated pickup point, the group leader or designated passenger representative is invited to inspect the tempo traveller alongside the chauffeur. This includes verifying seat upholstery cleanliness, operational dual-blower AC cooling, functioning audio/LED entertainment systems, boot luggage space, and starting odometer reading.

Immediate Amenity Rectification

If any minor amenity is found suboptimal prior to journey commencement, the client must immediately notify our 24/7 dispatch supervisor (+91 74570 73773) for prompt resolution. Commencing the journey without lodging an immediate formal objection at departure constitutes conclusive proof of full customer satisfaction with vehicle condition, precluding subsequent claims for retroactive refunds.

Section 10

10. Frequently Asked Questions (FAQ) Regarding Refunds & Deposits

Q1: Why is the advance booking token strictly non-refundable even if I cancel well in advance?

Answer: When you book a tempo traveller, that specific commercial asset is withdrawn from our booking system. Because high-demand luxury tempo travellers (especially 9, 12, 16, 20, and 26-seater Maharaja/Urbania configurations) are limited in number, we turn away multiple other prospective clients who request that vehicle for the same dates. Furthermore, drivers are rostered and garage maintenance schedules are locked. If you cancel, the carrier cannot recover that lost business, making the token amount necessary liquidated damages to cover holding and opportunity losses.

Q2: What happens if our connecting flight or train to Delhi / NCR is delayed by several hours?

Answer: If your incoming flight or train is delayed, your booking is NOT cancelled, and no refund is required. Your assigned chauffeur will wait at the airport or railway terminal. While reasonable flight delay waiting is accommodated, prolonged waiting exceeding standard grace limits may incur standard garage parking and driver overtime charges, which are settled with the final billing.

Q3: Can I transfer my advance booking deposit to a colleague, friend, or relative?

Answer: In standard circumstances, advance bookings are non-transferable. However, if you notify our central office at least five (5) days prior to departure in writing with the full name, government ID, and contact details of the substitute hirer for the EXACT SAME route, dates, and vehicle category, management may approve a passenger profile re-assignment subject to a nominal administrative transfer fee.

Q4: What if poor weather or hill landslides make our planned destination inaccessible?

Answer: If authorized government authorities close mountain passes or national highways due to landslides or severe weather, our operations team will consult with your group leader to provide safe alternate routing (for example, diverting from an inaccessible valley to an alternate scenic circuit) with kilometer tallies reconciled accordingly. If you choose not to proceed to any alternate destination, Section 6 Force Majeure rules apply, granting an SJT Future Travel Credit Note.

Q5: How are security deposits handled for outstation charters?

Answer: Where refundable security deposits are collected for long-term charters or corporate events (to cover potential interior damages or route extensions beyond contracted limits), such deposits are inspected and refunded in full via original digital banking channels within twenty-four (24) hours following successful vehicle return and garage inspection sign-off.

Section 11

11. Dispute Resolution Escalation Matrix & Territorial Jurisdiction

In the event of any billing contestation, accounting discrepancy, or service grievance regarding refunds or advance deposits, the client must follow our formal three-tier resolution hierarchy:

Tier 1: Billing Desk

Submit written grievance with booking voucher and payment UTR to info@shrijeetravels.com. Initial acknowledgment within 24 hours; preliminary evaluation within 48 hours.

Tier 2: Management Review

If unresolved, matter is elevated to the General Operations Manager in Ghaziabad for comprehensive review of driver logs, GPS records, and operational timeline audits within 5 working days.

Tier 3: Judicial Jurisdiction

Any remaining legal dispute shall be subject to the exclusive territorial jurisdiction of the competent courts of Gautam Buddha Nagar (Noida) and Ghaziabad, Uttar Pradesh.
