Terms & Conditions of Commercial Fleet Charter
Comprehensive legal charter governing vehicle hire contracts, passenger safety standards, lawful carriage obligations, and liability limitations for Shree Ji Travels.
Contractual Agreement Between Hirer & Shree Ji Travels
This document constitutes a legally binding Master Service Agreement between Shree Ji Travels (the Carrier) and the individual, enterprise, or group tour coordinator contracting vehicle charter services (the Hirer). Commencing a reservation inquiry, remitting an advance deposit, executing a digital booking voucher, or boarding any vehicle operated by Shree Ji Travels constitutes unconditional, voluntary acceptance of all contractual terms, safety standards, passenger conduct covenants, and limitation of liability clauses set forth below.
1. Legal Entity, Regulatory Compliance & Capacity to Contract
Shree Ji Travels is an authorized commercial fleet operator and passenger road transport carrier registered under applicable commercial licensing authorities in Uttar Pradesh and the National Capital Territory of Delhi, maintaining administrative and operational centers at Sector 63 Noida, Indirapuram Ghaziabad, and Karol Bagh New Delhi.
All transportation contracts facilitated by Shree Ji Travels comply with the Motor Vehicles Act, 1988 (read with the Central Motor Vehicles Rules, 1989), the Carriage by Road Act, 2007, the Consumer Protection Act, 2019, and the Indian Contract Act, 1872. The individual executing this agreement affirms that they possess full legal capacity (being at least eighteen years of age), sound mind, and necessary statutory authority to bind themselves, their traveling party, or their corporate entity to these terms.
2. Fleet Classifications, Seating Capacities & Strict Anti-Overloading Mandate
Shree Ji Travels provides dedicated passenger charter vehicles strictly configured and registered under commercial yellow-plate tourist vehicle permits issued by Regional Transport Authorities (RTO):
Authorized Seating Configurations
Our fleet comprises Force Tempo Travellers, customized Maharaja 1x1 recliners, Executive 2x1 coaches, and Force Urbania luxury vans registered under certified passenger capacities of 9+D, 12+D, 16+D, 20+D, and 26+D seats. Every passenger (excluding lap-held infants under 2 years of age) must occupy an independent, dedicated passenger seat equipped with safety restraint mechanisms.
Strict Anti-Overloading Prohibition
Under Section 194A of the Motor Vehicles Act, carrying passengers in excess of the officially certified seating capacity recorded on the vehicle registration certificate (RC) is a cognizable legal offense. Chauffeurs are legally prohibited from permitting standing passengers or boarding travelers beyond certified seating limits. Demands by the hirer to accommodate extra passengers will be refused without refund liability.
3. Tariff Calculations, Kilometer Tracking & Settlement Timelines
Commercial fleet charter rates are formulated upon established North Indian transportation industry accounting principles:
- Garage-to-Garage Accounting: In accordance with industry standards, journey distance and elapsed duty hours commence when the vehicle departs our designated regional garage (Noida/Ghaziabad/Delhi) and conclude upon the vehicle's physical return to the originating depot.
- Outstation Daily Distance Baseline: Outstation journeys are billed subject to a mandatory daily minimum distance threshold (typically 250 km or 300 km per calendar day depending on vehicle category). Where actual kilometers logged fall below the cumulative daily baseline, billing is calculated upon the minimum threshold.
- Calendar Day Definition: A charter day is counted on a standard calendar day basis (00:00 midnight to 23:59 midnight). Any operational movement, boarding, or vehicle retention past midnight constitutes a new calendar day, attracting standard daily vehicle rental and chauffeur allowance.
- Payment Settlement Hierarchy: The advance token deposit (25% to 50%) is payable at booking confirmation. For outstation journeys, 50% of the estimated balance fare must be disbursed to the driver or company accounts upon vehicle arrival at the pickup point, with the remaining final balance (plus actual toll/parking receipts) cleared prior to journey completion.
4. Lawful Usage, Anti-Contraband Mandate & Strict Substance Prohibitions
The hirer and all traveling passengers covenant to utilize the chartered vehicle exclusively for lawful tourism, pilgrimage, family transit, or corporate transport. The following activities are strictly prohibited by law:
Alcohol & In-Cabin Smoking
Consuming alcoholic beverages, using e-cigarettes, smoking tobacco, or chewing betel nuts (paan/gutka) inside the vehicle cabin is strictly prohibited under Indian public carriage laws. In dry states (e.g. Gujarat or Bihar), transporting liquor is a severe non-bailable criminal offense.
Contraband & Illegal Narcotics
Transporting narcotics, psychotropic drugs, unauthorized pharmaceuticals, commercial smuggling goods, wildlife products, or unmanifested commercial merchandise under the NDPS Act and Customs Act is completely barred.
Weapons & Hazardous Materials
Carrying unlicensed firearms, explosive fireworks, ammunition, compressed gas cylinders, corrosive chemicals, or inflammable liquid fuel canisters inside passenger or luggage compartments is strictly prohibited.
Legal Repercussion: Any violation of substance laws entitles the chauffeur to halt the vehicle at the nearest police station. The charter contract will be terminated immediately with 100% fare forfeiture, and all passengers shall be individually and severally liable for criminal prosecution.
5. Passenger Decorum, Chauffeur Dignity & Speed Governor Compliance
Commercial chauffeurs operating heavy passenger vehicles bear legal responsibility for life and road safety. Shree Ji Travels enforces zero tolerance for unruly passenger interference:
- Dignity & Non-Coercion: Chauffeurs must be treated with professional respect. Verbal abuse, physical intimidation, or coercing a chauffeur to violate traffic signals, drive along prohibited one-way streets, or travel along unpaved hazardous embankments is strictly prohibited.
- Speed Governor Compliance: All fleet vehicles are equipped with statutory electronic speed limiters (calibrated at 80 km/h) mandated by MoRTH and verified during fitness certification. Passengers must not pressure chauffeurs to tamper with speed governors or exceed statutory expressway speed ceilings.
- Resting Hours & Driving Fatigue Safeguard: Commercial chauffeurs require adequate biological rest to maintain sharp reflexes. In the interest of passenger safety, chauffeurs cannot be required to drive continuously exceeding 8 to 10 hours without mandatory meal and rest intervals.
6. Vehicle Care, Interior Upholstery Preservation & Damage Recovery Penalties
Our luxury interiors feature plush leatherette recliners, hardwood-finish flooring, ambient LED acoustic lighting, and modern multimedia soundbars. The hirer assumes full financial liability for damages caused by traveling members:

7. Route Feasibility, Terrain Constraints & Night Mountain Driving Bans
Passenger safety supersedes all travel schedule desires. The assigned chauffeur, in coordination with our central dispatch controller, possesses full legal and operational authority to assess route viability:
A. Dangerous Terrain Disclaimer
Chauffeurs have the unrestricted right to decline navigating narrow village lanes, unpaved muddy tracks, waterlogged subways, or dangerous riverbeds unsuitable for long-wheelbase commercial tempo travellers. In such scenarios, the vehicle will halt at the nearest safe paved parking terminal, and passengers must arrange local last-mile transit.
B. Mountain Night Driving Restrictions
Under state transport directives in Uttarakhand and Himachal Pradesh, commercial passenger driving in high-altitude mountain sectors between 08:00 PM and 05:00 AM is legally prohibited due to hazardous fog, active landslide risks, and narrow hairpin corners. Chauffeurs must halt at the nearest safe foothill or town lodge for the night.
8. Passenger Baggage, Valuables & Property Custody Disclaimer
Shree Ji Travels transports passengers and their personal baggage as a common commercial carrier. In accordance with Section 10 of the Carriage by Road Act, 2007:
- Passenger Sole Custody: All personal valuables—including cash, jewelry, bullion, credit cards, mobile phones, laptops, photographic lenses, and official identity documents—remain in the exclusive physical custody and personal care of the passenger at all times.
- Vehicle Parking Disclaimer: While chauffeurs lock the vehicle cabin during scheduled meal stops and monument visits, Shree Ji Travels shall not be held liable for theft, loss, misplacement, or accidental damage to personal belongings left inside the vehicle cabin or luggage boot.
- Lost and Found Assistance: If a passenger inadvertently leaves an item inside the vehicle, our dispatch team will endeavor to assist in locating it upon prompt notification. Any courier dispatch charges or driver deadhead transit required to deliver recovered property shall be borne entirely by the passenger.
9. Limitation of Carrier Liability & Comprehensive Third-Party Insurance
All commercial vehicles operated by Shree Ji Travels carry valid comprehensive commercial insurance policies issued by leading government and IRDAI-regulated insurance underwriters:
- Third-Party Liability: Comprehensive commercial vehicle insurance covers statutory third-party passenger liability in strict compliance with Chapter XI of the Motor Vehicles Act, 1988. In the event of a road traffic accident, compensation claims are adjudicated exclusively through the Motor Accident Claims Tribunal (MACT) possessing territorial jurisdiction.
- Exclusion of Consequential Losses: Under no circumstances shall Shree Ji Travels, its directors, managers, or employees be liable for indirect, incidental, special, or consequential damages, including loss of business profit, missed flight or train connections due to highway traffic bottlenecks, hotel reservation forfeitures, or business meeting cancellations.
- Maximum Monetary Ceiling: To the maximum extent permitted by applicable law, the aggregate financial liability of Shree Ji Travels for any contractual breach, delay, or service claim arising from a charter shall strictly not exceed the total rental consideration actually received from the hirer for that specific journey.
10. Intellectual Property Rights & Digital Platform Governance
The official digital domain (shrijeetravels.com), reservation engines, brand logos, photographic assets of the Shree Ji Travels fleet, proprietary route planning software, and published editorial content are the exclusive intellectual property of Shree Ji Travels.
Any unauthorized reproduction, digital scraping, automated bot indexing, commercial republication, framing, or exploitation of our brand trademarks or vehicle imagery without prior express written authorization from our corporate legal department is strictly prohibited and will be prosecuted under the Copyright Act, 1957 and the Trade Marks Act, 1999.
11. Dispute Resolution, Arbitration & Exclusive Territorial Jurisdiction
This Master Service Agreement shall be governed by, interpreted, and construed in accordance with the substantive laws of the Republic of India:
Amicable Negotiation & Conciliation
In the event of any contractual controversy, billing dispute, or service contestation, the parties shall first attempt to resolve the issue amicably through executive-level negotiation by submitting a formal written memorandum to info@shrijeetravels.com within fourteen (14) days of journey completion.
Sole Arbitrator & Judicial Courts
Unresolved disputes shall be referred to binding arbitration conducted in accordance with the Arbitration and Conciliation Act, 1996. The seat and venue of arbitration shall be Noida / Ghaziabad. The civil courts located within Gautam Buddha Nagar (Noida) and Ghaziabad, Uttar Pradesh shall have exclusive jurisdiction over all judicial proceedings.
